Take legal actions agains Customer, allowed?
Can I take legal actions against a customer as they have left a review stating my product is not authentic although it surely is and they have no evidence. I personally think they want to get the item for free.
Tried all the routes possible including sending them a message but nothing. Can I send a demand letter to their address ?

is this the 1 star feedback from 5th May 2025 that Amazon struck through?

Amazon may frown but you can threaten the customer with court action if you really want to having considered the potential implications.
While you may well be correct in your assumption the customer was looking for a freebie and the feedback they left was defamitory, any further steps by you are fraught with potential legal costs.
You're accusing the customer of written defamation i.e. libel which isn't resolved at small claims court level, only high court.

Legally? I don't know. I wouldn't feel comfortable advising on that as I'm not a legal professional.
Doing so is against Amazon t&cs, though, so you would be taking a risk.

You can but its against amazon T&Cs so you could get your account closed

I don't believe that is the case any more but happy to be proved wrong if you can point out where they state this.

NO
irrespective of any amazon rules..
Written word is defamation and in the UK there is the 'Defamation Act'. in this act to bring a case for defamation there is the 'Serious Harm' clause
So unless you can prove that serious harm Has been caused you wouldn't even get to court, there is also the fact that defamation cases are 'civil' so the most you'll get is a 'sorry' and possible compensation.. the latter assuming there is money to pay for this

Hi @Carmella_s_beauty
Sandy from the Community manager team here. I can't speak on the legal aspect, but I can say that as general rule, Amazon doesn’t remove customer reviews, unless they violate Community Guidelines. If you see a review that does violate our Community Guidelines, you should report it.
If you think this is left from a potential competitor and have evidence to back that up, please also note that in your report.

We have done before and won...
It was about delivery fraud, it feels good to know that unlike amazon's threatment to sellers, there is actual justice outside amazon, and justice system is fair, unlike amazon...
There are so many freelancer lawyers around who are waiting to take small cases against amazon..
Our order value was around 100 eur, lawyer got 200 eur, court, paperwork etc cost around 600 eur something, the nice thing is all paid by the fraud buyer :D
Don't hesitate to take things to real justice system, amazon is not a fair place for sellers to do business, amazons rules and terms are customer satisfaction only and amazon makes sellers pay for that customer satisfaction.
We are now prepearing to get the cost of 6 months of non returned goods from multiple sellers. Amazon does not force buyers to return the items that thats the sweet spot lawyers like to itch :)

Wow good for you @Seller_31LTsuPwSYPYI and I would say go for it, let buyers be careful when they claim inr. However @Seller_H1mB28ANckpPr issue is about authenticity. Different ramifications on this one. Need to tread very carefully because the court would need several documentation from you to justify that this is one to pursue as a court case.
I will share what happened to an acquaintance seller. They sold make-up. The buyer claimed that the mirror was broken and therefore wanted full refund. Instead of obliging, this guy questioned the buyer, asked her for photos, to which the buyer claimed that it was already binned and so couldn't retrieve it to prove that the mirror was broken. The seller persisted. The buyer was angry contacted Amazon and raised an a-z. Seller naturally lost case because amazon went with the buyer as the unit was deemed "unsafe". Then there was a suspension on seller account for selling "unsafe" unit and amazon asked for multiple documents from seller to prove authenticity. Only "authenticity" could apparently prove that it was a "safe" unit.
So effectively this seller shot on own foot.
Amazon suspended his account for 4 months as the seller had to work so hard to prove "authenticity". That specific brand was then banned and he couldn't sell it anymore as Amazon was not convinced by the invoices he produced.
So my point is that do think very hard before going this route on "authenticity" claims. I am pretty certain that Amazon will pick on this review. This is one of those incidents where you need to lay low and take the hit of one review. Just my earnest advise, I wouldn't know how much the review has affected you though.
